FMLA is intended to allow employees to balance their work and family life by taking reasonable unpaid leave for medical reasons, for the birth or adoption of a child, for the care of a child, spouse, or parent who has a serious health condition, for the care of a covered service member with a serious injury or illness, or because of a qualifying exigency arising out of the fact that the employee’s spouse, son, daughter, or parent is on active duty or call to active duty status in support of a contingency operation. The Act is intended to balance the demands of the workplace with the needs of families, to promote the stability and economic security of families, and to promote national interests in preserving family integrity.

In this program, “The Federal Family and Medical Leave Act – Essential Fundamentals” we will provide you with a concise overview of key federal FMLA issues.

In this program, we’ll show you how to manage an FMLA leave from start to finish. Our intent is to provide you with a concise set of steps to help guide you through the FMLA process.

In this program, we’ll be focusing on the 12-month period options available in the regulations, the interaction with State leave laws, requirements for leave involving care of an injured or ill service member, and tracking employee FMLA usage.

There are several key decisions that need to be made when an employee calls in sick. First, is the condition covered by the FMLA regulations? Second, is the employee eligible for FMLA? Third, how do I confirm the condition is covered by the regulations? Fourth and finally, how do I communicate to the employee that the absence may or may not be covered by FMLA?

We’ll look at each decision step and provide you with concise instructions on how to administer the leave.

Part of FMLA entitlement is the availability of leave for the serious health condition of the employee, an immediate family member, or a covered service member’s illness or injury.

There is more than one definition of a serious health condition in the regulations, and it’s important for an organizations FMLA administrator to be familiar with these definitions.
