Session 1:
Arrest & Conviction Record Discrimination: How Not to Catch a Case
This session provides an overview of how arrest and conviction records may be used by employers under Wisconsin and federal law, with a focus on compliant hiring practices, discipline decisions, and risk mitigation.
Beth will cover compliance with the Fair Credit Reporting Act and federal EEO laws. In addition, she will explain Wisconsin’s arrest and conviction record discrimination law, including the key differences between arrest and conviction records, Wisconsin’s “substantial relationship” test, how the substantial relationship test applies in the case of arrests versus convictions, and other exceptions to the prohibition against discrimination.
Beth will also provide insights on how to make lawful employment decisions based on factors other than the arrest or conviction record. Participants will leave with practical guidance on applying the substantial relationship test, making smart employment decisions, and reducing discrimination risk.

You will learn how these laws interact, how to administer leave and accommodations consistently, and how to reduce organizational risk while supporting employees through difficult times.
