Both Wisconsin and the federal government have laws that require covered employers to give advance notice of certain changes in business operations. In general, the federal and Wisconsin laws have similar requirements, but there are a number of nuances in Wisconsin laws about which employers in Wisconsin must be aware. In situations where Wisconsin law contains a more restrictive provision than the federal law, the Wisconsin rule will govern (and vice versa).
Two events must occur before the notice requirements of federal and/or state law arise: (1) the employer must be covered by the law, and (2) the particular plant/business closing or mass layoff must meet the trigger requirements specified in the law.
