Based on current developments, it appears unlikely that employers will be required to submit EEO-1 reports for the 2026 reporting cycle. Additional guidance will be provided once the proposed rule is released.
What Employers Need to Know
- The EEOC has submitted the proposed rule to the White House's Office of Information and Regulatory Affairs (OIRA) for review.
- If finalized, the rule would eliminate the longstanding requirement for covered employers to report workforce demographic data by job category, sex, race, and ethnicity.
- The EEO-1 reporting portal has not opened, creating uncertainty about whether reporting will be required.
- Until the rulemaking process is complete, the current reporting requirement has not officially been rescinded.
