U.S. Citizenship and Immigration Services (USCIS) recently published an updated version of Form I-9. The new form has a revision date of January 20, 2025, and reverses some changes made to the previous revision, including replacing “noncitizen authorized to work” with “alien authorized to work” in the list of available immigration status options that can be selected. Other changes included revising the descriptions of two “List B” documents in the “Lists of Acceptable Documents” and adding appropriate statutory language and a revised DHS Privacy Notice to the instructions.
If you have not been using this form since January 20, or since the USCIS’s April 2 announcement, do not panic. Two previous editions remain valid until their respective expiration dates:
- Form I-9 (August 1, 2023 edition) that is valid until July 31, 2026.
- Form I-9 (August 1, 2023 edition) that is valid until May 31, 2027.
Also, starting April 3, 2025, E-Verify and E-Verify+ will have updated the Citizenship Status selection during case creation to reflect this statutory language.
